1. Acceptance of Terms

By accessing and using Psicosuite ("the Platform"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our platform. These Terms are governed by the laws of Ecuador, and Psicosuite is operated by STOec, a company registered in Ecuador. Our servers are located in the United States.

2. Description of Service

Psicosuite is a digital therapy platform designed for mental health professionals. The platform provides tools for patient management, video sessions, calendar synchronization, clinical documentation, and EMDR therapy tools. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. User Accounts and Registration

To use our platform, you must:

  • Be at least 18 years old and legally capable of entering into binding contracts
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials and notify us immediately of any unauthorized access

4. Acceptable Use

You agree to use the platform only for lawful purposes and in accordance with these Terms. You must not: (a) use the platform in any way that violates applicable laws or regulations, (b) transmit any harmful, offensive, or illegal content, (c) attempt to gain unauthorized access to the platform or other users' accounts, (d) interfere with or disrupt the platform's operation, or (e) use the platform to infringe upon the rights of others.

5. Patient Data and Confidentiality

You are solely responsible for all patient data you enter into the platform. You must ensure that you have obtained all necessary consents and authorizations before entering patient information. You agree to comply with all applicable healthcare privacy laws, including HIPAA where applicable. We implement security measures to protect data, but you are responsible for maintaining the confidentiality of your account credentials.

6. Intellectual Property

All content, features, and functionality of the platform, including but not limited to text, graphics, logos, and software, are owned by STOec or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

7. Subscription and Payment

Access to certain features of the platform requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice. You are responsible for all charges incurred under your account.

8. Free Trial

We may offer a free trial period for new users. The trial period and features available during the trial are at our sole discretion. Upon expiration of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the platform will cease immediately.

10. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or secure. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, STOec and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the platform.

12. Indemnification

You agree to indemnify, defend, and hold harmless STOec, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of any rights of another party.

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Ecuador. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ecuador. For any questions or concerns, please contact us at [email protected].
